Official Rules: CowBoom DealCow Holiday Giveaway

1. ELIGIBILITY:  NO PURCHASE NECESSARY TO PARTICIPATE OR WIN. PURCHASE WILL NOT ENHANCE CHANCES OF RECEIVING PROMOTIONAL CONSIDERATION. The CowBoom DealCow Holiday Giveaway Offer Promotion (“Promotion”) is open and offered only to legal residents of the 50 United States and District of Columbia, 18 years of age and older (except residents of Alabama and Nebraska, who must be 19 years of age or older) at time of entry. Employees and directors of Best Buy Stores, L.P., dba CowBoom (“Sponsor”), and their respective parent entities, subsidiaries and affiliated companies, advertising, promotion, or production agencies, any companies who are performing work in Sponsor’s stores at Sponsor’s request, and Web masters and Web suppliers (and their respective IRS dependents, immediate family members [children, spouse, parents, siblings and their respective spouses, regardless of where they reside] and individuals residing in their same household, whether or not related) are not eligible to participate. Void outside the 50 U.S./D.C. and where prohibited. By participating in the Promotion and accepting promotional consideration (e.g. DealCows and/or Giveaway Promotional Codes) , Participants (as defined below) agree to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to this Promotion.
2. PARTICIPATION:  From 11/10/11 beginning at 12:00:01 am Pacific Time (“PT) through 11:59:59 pm PT on 12/12/11,  five hundred (500) DealCows will be either randomly inserted into valid and confirmed bids/orders from www.CowBoom.com or mailed out in response to free, alternative method of participation requests (as defined below, “AMOEs”) of which four hundred ninety five (495) Promotional DealCows will include a special Promotional offer code for $5.00 off a future purchase of $50.00 or more and of which five (5)  Promotional DealCows will include a special Promotional offer code for $100 off a future purchase at www.CowBoom.com of $100 or more.  Odds of receiving a Promotional DealCow/offer code depend on the number and order of valid and confirmed www.CowBoom.com bids/orders received and the number and order of AMOEs received.  Promotional codes MUST be used in a single transaction and expire at 11:59:59 pm PT on 2/1/12.  Free Alternative Method of Participation Requests (AMOEs):  To freely participate in the Promotion by mail, a Participant must clearly hand-print his/her full name, street address, city, state, and zip code (no PO Boxes), daytime telephone number and current age (collectively referred to as “Non-Optional Information”), and valid email address (optional) on a 3” x 5” card and mail, with proper postage affixed, to: CowBoom DealCow Holiday Giveaway ATTN:  AMOEs, 30 Executive Park, Suite 100, Irvine, California 92614.  Limit one (1) hand-printed request per envelope.  Copies or mechanical reproductions of Non-Optional Information and/or email addresses will not be accepted and will be disqualified.  Eligibility to participate in the Promotion is NOT dependent on mail-in Participant’s provision of a valid email address.  Sponsor may use email addresses provided via mail-in for Promotion-related notification purposes only.  Mail-in requests must be postmarked by 12/12/11 and received by 12/16/11.  Mail-in requests become the property of the Sponsor and will not be returned.  Any attempt by a Participant to enter or participate contrary to these Official Rules will result in disqualification, at Sponsor’s discretion. Sponsor’s computer will be the official time clock for the Promotion.
3. CONDITIONS OF PARTICIPATION: Participants agree (a) that Sponsor, and its parent entities, subsidiaries and affiliated companies, advertising and promotion agencies, any companies who are Promotional participants, and Web masters and Web suppliers, and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”), will have no liability whatsoever for, and shall be held harmless by Participants against any liability for any injuries, losses or damages of any kind to persons, including death, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any Promotional consideration or participation in this Promotion or any Promotion related activity, or for any printing, production, technical, typographical, human or other error in the printing, offering or announcement of any DealCow/special Promotional code; and (b) except where legally prohibited, Promotional code recipients grant (and agree to confirm that grant in writing) as a condition to using such Promtoional code, permission for Sponsor and those acting under its authority to use his/her name, photograph, voice and/or likeness, for advertising, trade and/or publicity purposes (including, without limitation, winner status announcement) without additional compensation in all media now known or hereafter discovered, worldwide and on the Internet and/or World Wide Web, in perpetuity, without notice, review or approval. By participating in this Promotion, you acknowledge and agree that Sponsor may collect the personal information submitted by you, and use the information pursuant to Sponsor’s privacy policy available on-line at www.bestbuy.com http://www.cowboom.com/privacyPolicy.cfm or by calling   1-888-602-6963
4. LIMITATIONS ON LIABILITY: Released Parties are not responsible for illegible, lost, late, damaged, destroyed, inaccurate, delayed, incomplete, unintelligible, non-delivered, misdirected, stolen electronic or hard copy communications, or for incomplete, inaccurate, lost, interrupted or unavailable network, satellite, telephone networks or lines, cellular towers or equipment (including handsets), computer on-line systems, computer equipment, software, viruses or bugs, servers or providers, or other connections, availability or accessibility; or for unauthorized access to, or alteration of Promotion-related communications; or miscommunications, failed computer, telephone, cellular, satellite, or cable transmissions, lines or other technical failure; or for jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties; or for any other errors of any kind, whether human, technical, mechanical, electronic or network, including, without limitation, any errors which may occur in connection with the administration of the drawing or in any drawing-related materials; or for the incorrect or inaccurate capture of participation or other information, or the failure to capture any such information. Persons who tamper with or abuse any aspect of the drawing or Web site, as solely determined by the Sponsor, will be disqualified (and all associated Entries will be void), and Sponsor reserves the right to terminate such entrant’s eligibility to participate in this or any other promotion offered by Sponsor. Entries generated by robotic, programmed, script, macro or other automated means or by any means which subvert the entry process will be disqualified. Released Parties are not responsible for injury or damage to Participants’ or to any other person’s computer related to or resulting from participating in this Promotion or downloading materials from the Web site. Should any portion of the Promotion be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Participation communications or requests, Sponsor reserves the right at its sole discretion to suspend or terminate the Promotion and select recipients of randomly seeded DealCows from all non-suspect, eligible bids/orders and AMOPRs received, or as otherwise deemed fair and appropriate by Sponsor. Without limiting the release provided above, and for greater certainty, Released Parties will not be liable for (a) any incomplete or inaccurate information, whether caused by wireless device users or by any equipment or programming associated with or utilized in the Promotion, or by any technical or human error which may occur in the processing of participation communications/requests; (b) the theft, destruction or unauthorized access to, or alteration of, participation communications/requests; (c) any problems with or technical malfunctions of telephone networks or lines, computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (d) any failure of any message to be received by or from Sponsor for any reason including but not limited to traffic congestion on the Internet or wireless waves or at any Web site or combination thereof; or (e) damage to a Participant’s or other person’s system or equipment occasioned by participation in this Promotion.
IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEB SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM WWW.COWBOOM.COM, WWW.BESTBUY.COM, OR ANY OTHER WEB SITE ASSOCIATED WITH THIS PROMOTION. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEB SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
5. GOVERNING LAW: Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the state of Minnesota, without regard to conflicts of law. All suits or claims brought in connection with this Promotion must be brought in a state or federal court in Minneapolis, Minnesota.
6. OFFICIAL RULES REQUEST: For names of recipients of $100 off a purchase of $100 or more Promotional offers or a copy of these Official Rules, (a) send a self-addressed stamped envelope in a separate, first class stamped envelope to ATTN CowBoom DealCow Holiday Giveaway Promotion Rules/High Value Offeree’s List (designate which or both), 30 Executive Park, Suite 100, Irvine, CA 92614. Requests must be received by December 16, 2011. Promotional offer recipients may also be announced on the CowBoom blog, Facebook and Twitter pages or other Sponsor platforms, at its discretion.    Official Rules will also be posted at www.CowBoom.com.
